Who Needs an Explosives License?

You need an explosives license if you are involved in any of the following activities:

  • Production of fireworks, detonators, and blasting explosives
  • Possession of explosives for commercial purposes
  • Selling or distributing fireworks or industrial explosives
  • Transporting explosives from one location to another
  • Storage of explosive materials (for mining, quarrying, etc.)
  • Using explosives for blasting in building, mining, or infrastructural operations.

Types of Explosives Licenses

These are the Types of Explosives Licenses in India in Explosives Act, 1884 and Explosives Rules, 2008:

Manufacturing License:

This was issued to facilitate manufacturing of explosives, that is, industrial explosives, fireworks and ammunition.

Storage License:

It is mandatory to store explosives in licensed rooms such as magazines or go downs under conditions that are recognized as being safe.

Sale License:

Ordered to sell imports, distribute the imports, or sell the explosives.

Transport License:

  • Hazmat transporters

Use License:

Import License:

Important Points

A fee can be based on:

  • Quantity
  • Storage conditions
  • Region or area
  • Type of explosive (industrial, fireworks, defense-related, etc.)

GST etc. may be charged.

Renewal Applications: They should be done long before the expiry date (about 30-60 days).

Late renewals can be charged with late penalties.

Some of the licenses such as import/export may only be valid during certain transactions.

Renewal Fees

The amount of renewal fee is normally the same as the initial license fee.

Late Fee: There is an option of paying extra charges when it becomes a delay in renewal.

Penalties for Non-Compliance with Explosives License

The non-observance of the stipulations of the Explosives Act 1884 and the Explosives Rules 2008 may result in stiff penalties such as fines, custodial imprisonment and forfeiture of licenses.

Safety Guidelines for Handling Explosives

  • Keep the temperature and ventilation in storage at the right levels.
  • Install alarms and firefighting apparatus.
  • Provide supervised handling and skilled personnel.
  • Post emergency procedures and warning indicators.
  • Keep track of movement data and the stock registry.
  • Observe the safe transportation guidelines. Cars need to be properly labelled and complied with.
